CROCOS LLP, hereinafter referred to as the “Operator“, offers any individual or legal entity, hereinafter referred to as the “Buyer“, paid services for booking and purchasing electronic bus tickets via the Internet (hereinafter referred to as the Services) on the website redbus.kz .
This offer, in accordance with art. 395 of the Civil Code of the Republic of Kazakhstan, is a public offer (hereinafter referred to as the Contract), the full and unconditional acceptance (acceptance) of the terms of which, in accordance with art. 396 of the Civil Code of the Republic of Kazakhstan, is considered to be the Buyer‘s specific actions – clicking the button “I agree to the terms of the agreement“ on the Website.
TERMS AND DEFINITIONS
The User is a person registered on the Website. Acceptance – acceptance of the terms of the Offer by clicking the consent button on the Website. Personal Account is a section of the Website that is accessible to the User after registration. The website is an online resource of redbus.kz and related domains. A carrier is a transport company that carries out passenger transportation by bus. Route – the direction of the trip between the points of departure and arrival. An electronic ticket is a digital document confirming the right to travel and containing information about the flight, seat and passenger. Boarding is the passenger‘s admission to the bus upon presentation of an electronic ticket and an identity document.
SUBJECT OF THE AGREEMENT
2.1. The Operator provides the Buyer with the opportunity to book and purchase electronic tickets for bus services of Carriers through the Website.
2.2. The Operator is an information intermediary between the Carrier and the Buyer and does not directly carry passengers.
2.3. An electronic ticket entitles you to a one-time trip along the selected route, date and time.
2.4. For boarding, the passenger must present an electronic ticket (in electronic or printed form) and an identity card.
2.5. The Carrier has the right to refuse boarding if the ticket data does not match the passenger‘s document or if the departure time is late.
RIGHTS AND OBLIGATIONS OF THE OPERATOR
3.1. The Operator provides up-to-date flight information, but the schedule may be changed by the Carrier without prior notice.
3.2. The Operator is not responsible for the Carrier‘s actions, including delays, cancellations, replacement of transport and the quality of transportation.
3.3. The Operator has the right to send the User notifications, SMS and email messages related to the order and information about the trip.
3.4. The Operator has the right to change the terms of this Agreement with the publication of a new version on the Website.
RIGHTS AND OBLIGATIONS OF THE BUYER
4.1. The Buyer is obliged to verify the correctness of the entered personal data when purchasing the ticket.
4.2. The Buyer must arrive at the place of departure no later than 15 minutes before the departure time.
4.3. The Buyer independently familiarizes himself with the rules of carriage of a particular Carrier.
TICKET REFUND TERMS
5.1. Ticket refund is possible before the departure time of the flight according to the rules of the Carrier.
5.2. The funds are refunded to the bank card from which the payment was made.
5.3. The refund fee may be deducted by the Carrier according to its tariffs.
5.4. After the departure of the flight, the ticket is considered used and no refund is made.
PRICES AND PAYMENT
6.1. The ticket price is set by the Carrier.
6.2. Payment is made by online bank card through a payment service connected to the Website.
FORCE MAJEURE
7.1. The Parties are released from liability upon the occurrence of force majeure circumstances.: natural disasters, emergencies, military actions, strikes, epidemics, and other circumstances that hinder the fulfillment of obligations.
DISPUTE RESOLUTION
8.1. Disputes are resolved through negotiations.
8.2. In case of failure to reach an agreement, the dispute is subject to consideration in court at the Operator‘s location.
